之前打電話給台中市勞工局 轉給專業人員後 尋問老生常談的離職規定 我問的很簡單: 未滿三個月離職,是否要提前告知,例如7天,還是可當天離職 結果專員跟我講: 依照勞基法第十六條： 勞動基準法第16條規定， 雇主依第十一條或第十三條但書規定 終止勞動契約者，其預告期間依左列各款之規定： 一、繼續工作三個月以上一年未滿者，於十日前預告之。 二、繼續工作一年以上三年未滿者，於二十日前預告之。 三、繼續工作三年以上者，於三十日前預告之。 扯這麼多...專員跳針跳很大 我凶狠的再問一次: 他勉強擠出說沒有特別規定 那...到底是可~還是不可~ 很遺憾,勞工局不敢給我答案 只"建議"比照三個月十日告知及交接 以後走法律後比較不會有爭議 (還要直接走法律...勞工局的作用是啥...) 好! 再問他即使勞動契約中有約定，《勞基法》保障勞工的規定更為嚴苛， 仍屬無效嘛? 他只說如果有跟僱主簽訂離職告知契約~可能要走民法~不屬於勞基法 因為簽再另一張(第二張) 算民法~ 阿?? 問了半天.... 資委會是什麼! 我懂了! 鬼島是什麼! 我懂了 我不怕被約談~因為講的都是事實 是電話專員太扯 還是資委會太扯 或是鬼島扯翻了 我不懂的點~其實很簡單 你清楚告訴我遊戲規則是怎樣 很難嗎 幹麻搞曖昧 談戀愛嗎 請問版上大大們 其他地方的勞工局 有給過正確答案嗎? -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 125.231.208.38 ※ 文章網址: http://www.ptt.cc/bbs/Salary/M.1396370499.A.828.html
