先動手被推倒 告前夫不起訴

基隆市諶姓男子3月因身體不適住進醫院，期間前妻前去探視，2人發生口角，前妻上前涉嫌毆打諶男的腿，反咬遭到諶男毆打左眼提告。

檢方以證人供詞，認為他身體虛弱，被攻擊時用手抵擋為正當防衛，予以不起訴。

不起訴書指出，諶男（64歲）今年3月因貧血、糖尿病、高血壓等病症住進醫院。同月14日林姓前妻前往病房探視，他見狀表示，「先前都潑我家油漆，現在來做什麼？」林女也不甘回嗆「潑你油漆又怎樣，我還敢打你」，衝上前伸手打他的腿。

諶男閃躲時順勢以右手推開前妻，她重心不穩摔倒在地，導致她左臉腫脹、左眼球挫傷及瘀傷等，林女憤而提出傷害告訴。

檢方認為諶男身體虛弱且患有多項病症，林女攻擊時他用手抵擋是出於正當防衛，且與證人供詞一致。
