真性侵或被報復？法官信了越南媽

一名越南媽媽被控以手指性侵3歲女兒，還拿木棍痛打女兒，她否認被控犯行，1審和2審法官都判她無罪。

越南媽媽說，她民國91年嫁來台灣後，被丈夫和婆婆暴力相向，98年逃家，她聲請保護令，夫家開始聯合對付她，要趕她回越南，她後來同意離婚並爭取到女兒監護權，她懷疑丈夫為了爭回女兒監護權，誤導女兒指控她。

法官說，女童只有下體紅腫，醫師診斷證明處女膜沒破裂，女童沒明確說出被母親施暴和性侵過程，無法證實女童曾被母親痛打和性侵，法官表示，檢察官只以女童的童言童語要認定媽媽的犯行，未考量到媽媽和前夫和婆婆的長期積怨。
