《傳產》潤旺建設廣告不實，公平會罰30萬元

【時報-台北電】公平會今日因潤旺建設公司在網路銷售「發現之旅」建案時廣告不實，以違反公平法處以新台幣30萬元罰鍰。

公平會表示，「發現之旅」建案廣告所載的傢俱配置圖，將虛線所圍成的空間規劃為室內居住空間，作為餐廳使用，整體觀之，足使一般消費者誤認該虛線所圍成的空間，為居室空間的一部分。

但是，公平會詢問依新北市政府工務局，發現所指空間是「機電室」，且依建築技術規則建築設計施工編第162條規定，並未計入容積樓地板面積，因而該空間日後應維持原使用，不得任意變更。

也就是說，如果購屋者日後作為客廳、餐廳等居室空間使用，即與原核定使用空間未符，將違反建築法第73條第2項規定，應依同法第91條第1項規定核處（即課處罰鍰、限期停止使用、命恢復原狀或強制拆除）。（新聞來源：工商即時 譚淑珍）
