kuso劉政鴻靈堂照　公民記者無罪定讞

去年7月，公民記者傅東森在臉書上合成苗栗縣長劉政鴻靈堂kuso照2張，包含苑裡反瘋車自救會成員葉天鴻在內，有上千名網友轉貼分享，劉政鴻控告2人公然侮辱，一審判2人無罪，劉提起上訴，今上午10點遭台中高分院駁回，傅東森、葉天鴻無罪定讞。
 
劉因趁大埔民眾北上抗議時，下令拆除大埔4戶，對媒體稱「機不可失」，傅不滿，kuso劉的靈堂合成照，寫上「天賜良機」反諷，葉等上千名網友在臉書瘋傳分享，劉怒告二人公然侮辱，7月31日辯論終結前，傅的律師要求傳喚劉當證人，說明靈堂照對他造成何等傷害？劉以多項公務在身未出庭。
 
一審以大埔案涉及重大社會公益，縣長代表政府與人民溝通、協調，掌握政府高權，對於人民評論的容忍程度，更應高於一般民眾，不該任意刑責相加，才符憲法保障言論自由，以及民主法治國家人民監督政府之旨。 (許淑惠／台中報導)
