辯合約寫「約」幾坪　建商少0.07坪判賠

新北市陳姓男子3年前向建商「永富開發」購買南勢角捷運共購宅「南方之星」，交屋後發現土地持分面積比合約少0.078坪，提告索賠，建商竟以合約提及房屋面積是「約」幾坪而非「共」幾坪拒賠，台北地院日前判建商須賠9.9萬餘元價差。

今日出版的《蘋果》報導，陳男提告指，2011年向永富開發購買「南方之星」預售屋，交屋後發現土地權狀記載的土地持分面積為17.33平方公尺，而合約記載17.59平方公尺，短少0.26平方公尺（0.07865坪），要求退費，永富竟以合約提及「買賣房屋總面積『約』為29.46坪」，而非「共」幾坪。法官不接受永富的看法，認定永富給的土地明明就短少0.26平方公尺，判陳男勝訴，判建商須賠9.9萬餘元。（方翊倩／綜合報導）
