翻牆被發現逃走　不算偷竊

基隆市1名35歲潘姓男子，日前路過1處民宅時，見四下無人便翻牆跳入，但要侵入屋內時觸發警報，嚇得拔腿循原路逃走，屋主調閱監視器報警，當晚有看到小偷跳進圍牆內，但不知有無進到屋內，不過屋內物品並未失竊，監視器也沒有拍到潘男偷竊畫面，但警方訊後仍依竊盜罪嫌將潘男送辦。

檢方認為無法證明潘男已開始物色財物，也難以認定已下手行竊，與竊盜罪構成要件未合，不起訴處分。（蔡進男／基隆報導）
