高檢署函文 各地檢署「夜間不得拒收人犯」

國內各地檢署常有夜間拒收通緝犯情況，唯有雲林地檢署長期來對外縣市送來的人犯都「照單全收」，致許多外縣市警察緝捕通緝犯，再遠再晚都要送雲林地檢署代執行，引起當事人不滿，高檢署昨天函文各地檢署要求不得夜間拒收，須依規定程序執行。

地檢署指出，警方逮捕通緝犯，夜間解送地檢屬歸案時，按規定須依通緝或緝捕單位就近解送，舉例而言，如果設籍雲林或被雲林院檢通緝的通緝犯，在某縣市落網，應就近在該縣市代執行，但長期以來，因有部分地檢署拒絕代執行，使得警方無法就近解送，只好遠送設籍或發布通緝的單位。

資深人員指出，這種不成文的作法，形成慣例，尤其許多易科罰金的通緝犯，雖設籍雲林，但人住外縣市，常被大老遠從外縣市送來，辦完繳款手續都已深半夜，都還得自己搭計程回家。

雲林地檢署主任檢察官郭志明指出，有部分地檢署與監所距離較遠，夜間解送較不便，所以才會請雲林檢方代執行。

嘉義地檢署主任檢察官陳昭廷說，嘉檢夜間從未拒收通緝犯，要求夜間值班法警依法執行，拒收將懲處，到目前未發生拒收情形。
