少女謊稱成年 男發生性行為不起訴

新竹縣29歲鍾姓男子，與16歲少女網路談戀愛，兩人發生3次性行為後，少女父親發現後提出妨害性自主告訴，但少女說欺騙對方「已滿18歲」、鍾男也說，得知後就未再發生關係，檢察官認定，兩人發生關係時，鍾沒有與未成年性交的「故意」，處分不起訴。

承辦檢察官認為，鍾男在不知情下，與少女發生性行為，且少女應對能力好，無法從外觀得知是否滿18歲，難認為符合「明知」性交對象未滿16歲的條件。

檢警調查，鍾姓男子在網路上與少女認識，兩人發展成男女朋友關係，今年3、4月間兩人在鍾男橫山鄉的家中，相繼發生3次性行為。不久，少女父親找上門，告訴鍾男女兒只有16歲，向警方報案。

檢方複訊時，鍾男坦承和少女發生3次性行為，但少女告訴他「我已經18歲了」，他在少女父親找上門時，才得知少女未成年，少女事因見瞞不住，才告訴他，「我只是高一生」。他說，交往時，從外觀看，不知道女友未滿18歲。

少女也向檢察官說，與鍾男交往後，因害怕未滿18歲，兩人會分手、會被父母接回家，才騙鍾男已經成年了。
