罵人「死肥婆」　男辯「言論自由」判刑

台中市一名黃姓男子(45歲)與當精神科醫生的弟弟有財產糾紛，3年前竟以「海賊王」、「強五攻擊機」等帳號，登上「醫學論壇」網站，辱罵弟弟是「狗頭醫生凸凸凸」、「癩蛤蟆」，又罵弟媳「死肥婆，喜道人長短、善造謠趁隙插針、嫌貧愛富、窺竊家產」。
 
黃男的弟弟和弟媳憤而提告，黃男坦承PO文，但辯稱弟弟在網站使用的圖像就是一個狗頭，才如此稱呼，至於「凸凸凸、死肥婆」等留言，黃男認為只是個人主觀價值判斷的評論，屬言論自由範疇，無不法。
 
但台中高分院認定黃男觸犯加重誹謗罪，且犯後毫無悔意，今判他5月徒刑，得易科罰金15萬元。(鄧玉瑩／台中報導)
