剪褲性侵學妹 男大生判3年8月

台南一所大學三年級男大學生，曾在烹飪比賽得金牌，卻在2013 年1月和2月，分別與學妹參加公益活動晚歸時，佯裝好心留宿學妹，趁兩名學妹熟睡後剪破褲子，指頭伸進陰道性交，或強脫衣褲吻胸猥褻。今天被最高法院依強制性交、強制性交未遂和猥褻三罪合併判刑3年8月確定。


【中央社╱台北2日電】一名男大學生去年趁著和學妹過夜時，剪破學妹內褲後性侵得逞。最高法院今天依妨害性自主罪判處男大生3年8月徒刑定讞。

判決指出，被告在1月找同校學妹出遊，藉故把學妹留宿在租屋處，在半夜利用學妹熟睡後，剪破學妹內褲，以手指性侵學妹得逞。

被告在隔月又想重施故技，強脫另名學妹的衣褲意圖染指，學妹奮力用手、腳抵抗，以下體受傷為由哀求阻擋，他才沒有得逞。兩名被害人事後報警處理。

被告事後坦承犯行，並透過學妹向被害人道歉，取得原諒並達成民事和解。

法官審酌他侵害他人的性自主權，但犯後態度良好、在校熱心公益、還要出國比賽，依妨害性自主罪判處3年8月徒刑。案經最高法院駁回上訴定讞。
