祕洞運私菸　7工人抗罰7875萬勝訴

海巡署2012年7月18日凌晨破獲罕見的香菸走私案，有私梟利用日據時代基隆漁港旁廢棄的秘密坑道，把不明船隻從海上運來的500箱、25萬包阿沙力ASALI私菸運上岸，當時海巡署抓到7名搬運工，移送法辦，但檢方認為香菸並非《懲戒走私條例》的管制物品，將7人不起訴，不過基隆市府仍根據私菸市價每包45元，依《菸酒管理法》裁罰7人各1125萬元，總計7875萬元。
 
7名工人收到罰款通知都傻眼，訴願失敗後，打行政訴訟抗罰，7人均主張只是受僱於綽號「澳仔」的男子來搬貨，講好每人5000元工資，根本不知道搬的是私菸，7人卻被處7875萬元天價罰鍰，有違比例原則。
 
台北高等行政法院審理認定，7名工人到坑道搬菸，不可能不知道是走私，但基隆市府確實處罰太重，違反「罪刑相當原則」，今撤銷基隆市府處罰，要基隆市府另作適當金額處罰。全案可上訴。
 
海巡官員查獲的廢棄坑道，長約140公尺、高70公分、寬1公尺，入口在基隆漁港旁的懸崖，離地約5公尺，裡面鋪設滑輪軌道，還有一間鋪草蓆的休息室。但該次查緝走私行動並未抓到私梟。(丁牧群／台北報導)
