免費代辦留學 客戶損害仍得賠

〔自由時報記者謝文華／台北報導〕行政院消保處通過教育部研擬的「海外留學定型化契約範本暨其應記載及不得記載事項」修正案，近期公告實施，未來代辦留學即使報酬零元，若造成消費者損害仍須賠償。

消保處近一年接獲十二件留學糾紛，如有留學業者未詳實告知辦理進度、以未收取報酬為由拒絕賠償損害、廣告不實、保證金退還等糾紛。

這次修正重點明訂留學業者須負損害賠償責任，額度以消費者已向海外教育機構繳交入學費用中未能退還金額的三倍計算，消費者若能舉證損害超過前述計算金額，業者應足額賠償。

另明訂業者應遵照受託事項辦理留學程序，並詳實告知辦理情形，不得任意更改或隱瞞重要資訊，如未告知應參加入學考試，以致消費者喪失資格等。

業者另應主動告知申請入學許可應備文件如介紹信、攻讀計畫、申請獎學金要件及時間、可否提供住宿等資訊；若業者延遲提出申請，導致留學事項無法完成，消費者有權終止契約並請求賠償。業者還應詳實記載海外急難聯絡人資訊，包括姓名、電話及電郵。

消保處提醒，簽約前應多參考定型化契約範本、多探聽口碑，若遇消費爭議可撥打「1950」消費者服務專線。
