園藝業者：劉政池委託挖地窖

苗栗縣長劉政鴻胞弟劉政池遭指控在陽明山國有土地下挖地窖，涉竊佔國土、違反水土保持法，士林地方法院上午傳喚挖地窖的業者葉憲忠說明。葉表示2004年劉政池以500多萬的代價委託他設置地下貨櫃屋，劉每天都到場監看，並指定投放貨櫃的地點。

葉憲忠說，施工3天後，台北市建設局突然上門取締，他才知他整的地是「違法開挖」，為此還向劉政池抱怨「你不是說有承租嗎？」並要求劉要負責處理，雙方撕破臉。

劉政池22日開庭時推稱地窖是園藝業者葉憲忠「自行開挖」，他不知情。法官詢問為什麼他也挖了一條連接通道，劉則解釋因為他想窺視地下室是否會塌陷、影響安全。

劉說，葉憲忠是陽明山上知名的園藝、石雕業者，對方曾透露利用鋼構屋、貨櫃屋可增加土地使用面積，還慫恿他說他的土地面積太小，做溫泉湯屋面積不夠。

劉說，他也懷疑鋼構屋的合法性，況且他的「七七行館」主建物當時都還未興建，並無開挖地窖的打算，但2004年時葉憲忠「卻主動挖」；他因發現葉等人施工破壞他土地上的圍籬，而前往關切。
