一夜情後被甩 女告男性侵判無罪

台東指揮部陳姓士兵去年透過交友APP認識花蓮1名女子，雙方發生一夜情，隔天女方卻被丟包在火車站，他逕行離去也不再聯絡，女方事後向警方控告他性侵。檢方起訴，但一、二審法官都認為女方因被男方丟包而挾怨報復，判決無罪，仍可上訴。

現年20歲的女方表示，她和陳姓男子透過交友APP「遇見」認識，去年4月相約見面，住進池上一家民宿，但他以暴力壓制，對她性侵得逞，隔天還把她丟包在關山火車站，也不再聯絡，事後她到醫院採取檢體報案。

陳姓士兵大呼冤枉，強調發生關係時你情我願，事後卻被控告性侵，還要求賠償，實在沒有道理。

女子在法官審理時，直接表達被丟包的憤怒，認為陳姓士兵用過就丟太無情。不過陳姓士兵表示，在女子手機中看見對方已有男友，才決定不再聯絡，以免發生問題，想不到卻因此被告。

她承認2人發生關係後，對方就翻臉不認人覺得「不舒服」，也認為做完後就把她扔在火車站離開，太無情、太冷酷，所以很生氣，「明明有檢體當證據，卻不被採信，「難道我就要被糟蹋好玩的嗎？」

不過，民宿負責人做證指出，事後收拾房間，並未發現有打鬥跡象，且離開時，2人也沒有爭執，女子事後還離開房間到公共浴室盥洗，當時並無異狀。法官因此不採信女方說詞，均判決陳姓士兵無罪。
