性侵酒醉嫩男 大叔被訴

47歲林姓男子邀陳姓友人到家中吃火鍋飲酒，陳男帶了2名友人同行，事後17歲少年酒醉留下來休息，林嫌趁機對他性侵。檢方偵結，依趁機性交罪將他提起公訴。

檢方表示，去年6月21日17歲少年在朋友邀請下，一同到林男家作客，邊吃火鍋邊喝啤酒，後來陳男和另一名友人先離開，少年喝醉酒留在林嫌住處休息。

林嫌見少年意識不清，藉口替他按摩，令他將衣物脫下，接著邊吻邊摸「嫩雞」，褪下他的內褲替他口交。林男事後驚醒，以外出吃消夜為由逃離現場。

林嫌足足大了少年30歲，突如奇來的舉動把他嚇傻了，事後林嫌找陳姓友人轉交1千5百元給他被拒，雙方約在餐廳談判時他坦承對少年伸出魔爪。

但林嫌辯稱，以為少年知道他是同志，對他也有意思，才會朝他下手，供稱吃飯喝酒時有觸碰少年身體，他並沒有不悅或推開，後來又說頭暈想去房間休息，他誤會對方在暗示他。

檢方認為，少年與林嫌第一次見面，對他是不是同志身分並不清楚，如果雙方是情投意合，那他幹嘛藉吃消夜為由逃離現場並報警，且事後約餐廳談判時林也有承認。檢方認定他犯趁機性侵，且少年未滿18歲，建請法官加重其刑。
