新北市八里雙屍案死者陳進福家屬向凶嫌謝依涵、媽媽嘴咖啡店老闆呂炳宏和兩名股東四人求償一千多萬元，法官昨判謝女賠六百卅一萬餘元；呂炳宏等三人不負賠償責任，全案可上訴。

死者陳進福的兩名兒子向謝依涵等人求償，分別是慰撫金一千萬元及喪葬費卅一萬餘元。陳的委任律師魏憶龍主張，呂炳宏身為謝女老闆，不僅有雇用的責任，且案發當天，呂炳宏長時間在店內，卻未發現謝女殺人行為，與兩名股東應共同負連帶賠償責任。

法官表示，謝依涵殺害陳進福時，是在淡水河邊的紅樹林，並非執行咖啡店長職務；謝女事先謀畫殺人行為，呂炳宏等三人無法避免發生此案，因此不負賠償責任。

投資持續下降但庫存持續回補，主要是因落後產能淘汰的政策遲滯。去年9、10月，大陸國務院頒布指向落後產能淘汰的大氣汙染防治行動計畫，與化解過剩產能指導意見，12月開始地方政府密集頒布細則並大力執行。

這次落後產能淘汰「真刀實槍」，且比以往更為嚴厲。這種政策預期推動了微觀企業在政策時滯期內加快生產，以最大化落後產能的經濟價值，從而導致宏觀層面的庫存回補，庫存被動回補縮小了去年4季的經濟下滑幅度。

本輪庫存周期的主動去庫存階段，是從2011年10月份開始並一直持續而沒有改變。當前，大陸經濟仍處於趨勢性下行通道中；而本輪庫存周期運行到現在庫存水準仍然偏高，意味著庫存週期仍然處於主動去庫存階段。

2013年9至12月的庫存回補，只是主動去庫存階段的一個插曲，沒有改變主動去庫存的周期性質。隨著「兩會」結束、政府工作步入正常節奏，淘汰落後產能政策時滯期將消失，庫存被動回補難以持續，主動去庫存將再次前行。

從政策內容來看，是《政府工作報告》已經確定的常規性、基礎性政策，並無超預期內容；從政策規模來看，和去年相比新增有限，其中中央預算內投資人民幣4,576億元，僅比去年增長4.4%。我們認為，目前的「穩增長」難以改變經濟下行趨勢。

在庫存周期中，主動補庫存與主動去庫存階段經濟預期一般比較穩定，股市會在主動補庫存階段穩定上漲、主動去庫存階段穩定下降；而在被動補庫存與被動去庫存階段，經濟信號比較紊亂，預期並不穩定，股市會在被動補庫存階段震盪下行，被動去庫存階段震盪上行。但是投資者預期變化又領先與實際經濟變化，因此股市會領先於庫存週期。

目前，無論是需求、供給還是價格，都看不到主動去庫存階段行將結束的任何跡象。庫存周期轉換的信號仍沒出現，A股將繼續承壓。（中國中信證券研究部策略組負責人）

診所最常遇到的糾紛就是溝通不良！包括費用的錯誤（答應的與實際收的不同）、診療內容的錯誤（答應的沒有做到）
例如診所答應的診療項目與病患認知上有所不同！
當然，診所沒有說明清楚就是不對，但是到最後法院判決仍舊是合理的，我們病患仍舊需要負擔費用！所以我希望診所可以事先在產品中提供動畫、文字說明文件給醫病雙方做確認，但是也會註記我們患者的診療臨床狀況，再有需求會有費用產生時，但都會經過我們患者同意後再予以額外治療跟收費，這樣會比較合理與減少醫病衝突。
