胎兒照非證據 告夫通姦不起訴

新竹縣黃姓婦人懷疑丈夫出軌，放錄音筆在車上，錄到丈夫與疑似小三女子對話，談到「老婆」、「老公開始在搭帳篷」等語，且在丈夫皮包發現女子在婦產科檢查的胎兒超音波照片，憤而提告，不過，2人都否認有姦情，檢方認為，無確切證據顯示2人有性交行為，罪嫌不足，做不起訴處分。

林男與鄭女否認，林稱未與鄭女有性行為；鄭女稱，「錄音檔中的聲音不是我的」，胎兒照是她與男友的小孩，與林男無關，因為檢查發現胎兒不健康決定墮胎，林男好心要幫忙，她才把照片給他看，矢口否認姦情。

檢方認為，錄音內容只能證明2人過從甚密，無法證明有性行為，且胎兒超音波照片無法證明是林男的種，處分不起訴。
