廢水沒據實申報 中油3人起訴

中油高雄廠遭檢舉利用雨天偷排廢水，高市環保局依行政法裁罰2630萬多元，並向雄檢告發。雄檢偵查，認為前後兩任廠長未確實審核公文就簽章，沒看出下屬在檢測申報表中造假，依違反水汙法等罪起訴他們。

雄檢調閱附近氣象站資料發現，中油高雄廠排放廢水的日期確實都是下雨天，雖有瑕疵但屬行政罰範疇。

查案時發現，中油每半年須向環保局申報的文件有問題，某些日期中油明明有排水，但申報表上的排放量數字卻是「0」，明顯登載不實。依違反水汙法和業務登載不實文書罪等，將中油前廠長陳水波、現任廠長李順欽和廢水專責人員林順益提起公訴。

高市環保局告發，指中油高雄廠平日將「洩放廢水」和「未接觸冷卻水」收集起來併入作業廢水處理，但雨天卻將它們和逕流廢水一起排入後勁溪。林姓專責人員辯稱，因中油高雄廠沒有針對洩放廢水設置流量計，所以很難申報數據。

現任廠長李順欽指稱，自己對洩放廢水流量記載為「0」也曾提出疑問，並問過專責人員，他們說10多年來這樣申報，高市環保局都沒有異議，且洩放廢水是透過第三廢水處理廠海放，還是有申報到作業廢水上。前任廠長陳水波辯稱，自己相信專業技師處理。李順欽被指控在不實申報表上簽名2次、陳水波4次。
