行政院長江宜樺指示勞動部研議依約還款的關廠勞工是否也能拿回退款。勞動部發言人陳益民昨天說，將根據公平、社會觀感和法制等面向，積極檢討退款的可行性。據了解，勞動部不排除以「補助」方式，讓早已還款的人有機會領回所有還款。

勞動部前天宣布，對所有訴訟中的關廠工人案件全面撤告，並將退回還款及不再追討欠款；但在勞動部提告前就已依約還款者，則不退款。

一千一百零五名關廠工人中，有六百廿五人可被撤告，獲得免還錢或退回還款，但最早還款的四百八十人除外，遭外界質疑「一案兩制」，有失公平；江揆昨也指示勞動部再研究，希望讓依約還款者也有機會領回還款。

勞動部長潘世偉表示，會再研究全面退款給關廠工人的可能性，這部分所需經費約兩億元。

勞動部仍視關廠工人案為「貸款」，撤告是因超過公法的五年請求權，政府在請求權時效消滅後才追討到的錢因而成了不當得利，所以必須退回；至於依約還款者，因還款都在貸款期限內或請求權時效內追回，有借有還，因而未在退款對象之列。

若要退款給早還款者，除非勞動部重新界定當初這筆錢是「代位求償」，但如此又等於承認勞動部過去的追債行為是錯誤的；勞動部已研究在不改變「貸款」認定下的可行方式，不排除以補助還款的方式，讓這些人也能拿回還款。

陳益民說，當初借給關廠工人的錢來自就業安定基金，並透過華南銀行代辦貸款案，若要以補助或其他方式退錢給依約還款者，就不能再使用就安基金的錢，要找其他預算來源。據悉，有人建議政府動用行政院第二預備金。

就安基金來源是雇主聘用外勞時每月所繳的就安費，用途須花在促進本勞就業，當初考量這些工人因雇主惡性倒閉失業，借這筆錢可助他們就業。

《科技》首創3D植牙整合服務，明基三豐進軍口腔醫材

【時報-台北電】佳世達旗下子公司明基三豐醫材，與以色列合作夥伴AB Dental Devices合資成立明基口腔醫材，推出3D植牙整合服務，正式揮軍牙科，集團在醫療產業的布局更趨完整。明基三豐醫材董事長陳其宏表示，期許集團醫療產業營收在5年內能衝上50億至100億元的規模，成為台灣最大的醫療器材供應商。

台灣一年植牙市場大約是30萬顆，平均一顆的價格是7萬至8萬元，相當於一年240億元的產值，而且這個市場還在成長當中。著眼於牙科的市場潛力，明基三豐與AB Dental Devices共同合作，將行銷歐美20餘年、60多國的「人工植體」，結合明基三豐的「3D術前規劃」系統、「3D列印手術導板」及電子化「整合服務」。

陳其宏指出，明基口腔醫材今年從台灣、越南出發，4月起開始銷售，目前在新加坡、印尼、馬來西亞、泰國、日本、菲律賓、大陸等亞洲國家都正在申請銷售執照。有信心在明年開始進軍泰國、下半年進入日本，至於中國大陸則是從江蘇省開始，在逐步往上海等其他省市拓展。(新聞來源：工商時報─記者袁顥庭／台北報導)
